Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Evolving Programs, Inc. ("Evolving Programs," "we," "us," or "our") governing your access to and use of Daily Briefings, available at dailybriefings.ai (the "Service"). Daily Briefings is a product of Evolving Programs, Inc. By creating an account, connecting an integration, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is currently offered in private beta and may change, degrade, or become unavailable at any time. Features described on the site may not yet be available to all users.

1. Eligibility and account

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract to use the Service. You are responsible for your account, for the accuracy of the information you provide, and for safeguarding your credentials. You agree to notify us promptly of any unauthorized use.

2. The Service

Daily Briefings produces personalized email briefings from sources and integrations you select, on a schedule you set. To do so, the Service ingests, processes, summarizes, and stores content from the data sources you connect.

3. Your data and the access you grant us

"Your Data" means content, configuration, and information you provide, generate, or authorize the Service to access on your behalf, including data retrieved from third-party providers you connect (such as Google, email, calendar, document storage, code repositories, and other integrations).

3.1 License to operate the Service

You grant Evolving Programs a worldwide, non-exclusive, royalty-free license to access, retrieve, store, transmit, copy, cache, index, parse, transform, summarize, analyze, and otherwise process Your Data solely as needed to:

  • Operate, provide, secure, maintain, and improve the Service for you;
  • Generate and deliver your briefings and other features you have enabled;
  • Train, evaluate, and improve internal models, prompts, and components used to deliver the Service, in each case using de-identified or aggregated data unless you have separately opted in;
  • Comply with applicable law and enforce these Terms.

This license lasts only as long as needed for the purposes above and terminates when you delete the relevant content, disconnect the integration, or close your account, subject to retention required by law or for backups.

3.2 Authorization to access connected integrations

When you connect a third-party integration, you authorize Evolving Programs (operating the Daily Briefings Service) to access that account using the scopes you grant, including the right to read messages, metadata, files, events, or other content exposed by those scopes. You represent and warrant that:

  • You have the legal right to grant such access and to authorize Evolving Programs to process the content available through it via the Service;
  • Your authorization complies with the terms of the underlying provider (for example, Google's API terms) and any applicable laws, policies, or organizational rules;
  • You will revoke access from your account settings (or directly with the provider) if you no longer wish to grant it.

3.3 Email access

If you authorize email access (for example via Google or another provider), you specifically grant Evolving Programs the right to retrieve messages and metadata from those mailboxes for the purpose of producing your briefings and operating features you have enabled. We do not use email content for advertising and we do not sell it. Our handling of Google user data is further described in our Privacy Policy and is subject to the Google API Services User Data Policy, including the Limited Use requirements.

3.4 Ownership

You retain all rights, title, and interest in Your Data. We do not claim ownership of Your Data. The licenses above are operational only.

4. Acceptable use

You agree not to:

  • Violate any law, regulation, or third-party right, including intellectual property and privacy rights;
  • Connect accounts you are not authorized to access or attempt to access another user's account;
  • Reverse engineer, scrape, or interfere with the Service or its infrastructure;
  • Use the Service to generate spam, phishing content, or unlawful surveillance;
  • Use outputs of the Service in a way that misrepresents the source of information or violates the terms of the underlying providers.

5. Beta service and changes

The Service is provided as a beta. We may add, change, or remove features, limits, or supported integrations at any time. We will use reasonable efforts to give notice of material changes that adversely affect you.

6. Third-party providers

The Service relies on third-party providers (including hosting, database, email delivery, model, and integration providers). Your use of third-party services through the Service is governed by their own terms. We are not responsible for third-party services and disclaim liability for their acts and omissions to the extent permitted by law.

7. Fees

The Service is currently free to use during the beta. We may introduce paid plans in the future and will provide notice and applicable terms before charging you.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to the Service, other users, or us. On termination, your right to use the Service ends, and we will delete or anonymize Your Data subject to legal and operational retention.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. YOU ARE RESPONSIBLE FOR EVALUATING THE OUTPUTS OF THE SERVICE BEFORE RELYING ON THEM.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVOLVING PROGRAMS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You will defend, indemnify, and hold harmless Evolving Programs and its affiliates from any claims, damages, liabilities, and expenses arising out of (a) Your Data, (b) your use of the Service, or (c) your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you and we consent to personal jurisdiction in those courts.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
